This publication provides a guide to planning law and practice in Western Australia.

Written for lawyers, councils and town planners, the service contains extensive commentary and case notes on planning legislation and regulations, planning processes and development categories. It includes annotated legislation, a case reporter, a planning dictionary and bulletins, providing a comprehensive resource for WA planning professionals.


  • Annotated PD Act, Regulations and R Codes: Annotated and up-to-date versions of the Planning and Development Act 2005, key planning regulations and the Residential Design Codes, offering detailed commentary on the operation and application of provisions (view sample pages).

  • Practice Notes: The Practice Notes provide guidance on planning issues and principles at all levels in the context of WA planning law and practice. The Practice Notes are set out according to topic (eg "Amenity", "Assessment", "Density") and development category (eg "Car parking", "Office", “Restaurant”, "Sub-division") and provide both practical commentary (on principles and practice) and case summaries (outlining factual scenarios, issues and outcomes) on the relevant topic or category. The Practice Notes cover matters arising in planning cases before the SAT and the WA Supreme Court, as well as key planning cases from other Australian jurisdictions and, in doing so, also provide a comprehensive case law monitoring service (view practice note topics). 

  • Planning and Development Dictionary: Commentary on how words and phrases used in planning instruments have been interpreted by the SAT and courts (view list of dictionary terms).

  • Planning Law WA Bulletin: A bulletin issued with each update to the service, providing a detailed report on recent planning law developments and cases (view sample bulletin).

Denis McLeod is Counsel at McLeods Barristers and Solicitors, a specialist public law firm providing services to local government and State agencies. Denis is a life member of the Local Government Planners Association, an Honorary Fellow of the Planning Institute of Australia and Adjunct Professor at Curtin University and the University of WA where he teaches planning law. Denis is Convenor of the WA Law Society’s Environment Town Planning and Local Government Committee and is a member of the Society’s Council.
